Buying off-plan at Ayla: how the process works

What you sign, when you pay, how delivery dates are written, when your title deed is issued, and what the warranty covers when you buy off-plan at Ayla in Aqaba.

Buying off-plan at Ayla how the process works

Buying a home before it is finished raises the same questions everywhere. What have I actually signed, when does my money leave, when does the home become mine on paper, and what happens if something is wrong after I move in. This walks through how each of those works at Ayla in Aqaba, in the order you meet them.

What You Sign, And What It Covers

The document that matters is the Sale and Purchase Agreement.

It identifies the specific residence you are buying, not a building or a phase, and it sets out the price, the payment schedule, the specification and the delivery period agreed with you. Ayla residences are sold freehold, so what you are buying is outright ownership of the home rather than a lease with an end date.

Read the specification against the unit plans attached to the agreement rather than against the brochure. A brochure describes a development. Your agreement describes your home, and where the two differ it is the agreement that governs.

When You Pay, And What Happens If You Change Your Mind

Your payment dates are agreed and confirmed before you sign. The schedule sits in the agreement, so you know each date and each amount from the start and can plan around them.

For Golf Residences phase two, if you decide not to proceed, Ayla retains the down payment and refunds any remaining amounts paid in accordance with the agreement.

How Delivery Dates Are Written

Ayla states delivery as a defined period rather than a single day. For Golf Residences phase two the anticipated delivery is the first quarter of 2029.

That is worth understanding before you plan around it. A period is a commitment to a span of months rather than to a date, and it is how the agreement will read, so build your own timing around the later end of it. If you are selling a home or ending a lease to move in, leave yourself the margin.

That period also shapes how you should read a sales conversation. A verbal expectation of an early handover is not what you signed, and the sensible habit is to plan against the document and treat anything earlier as a bonus. Ask, in writing, how Ayla will notify you as the period approaches and how much notice you will get before the inspection date.

If The Finished Area Differs From The Agreement

Buildings rarely finish to the exact square metre, and Ayla settles the difference in money rather than in percentages.

If the completed residence is larger than the area stated in your agreement, you pay for the additional area. If it is smaller, Ayla refunds you the difference. There is no tolerance band inside which the variance is absorbed, which means small differences are settled either way rather than written off.

Ask for the final measured area in writing at handover, and check it against the figure in your agreement before the last payment clears.

Registration And Your Title Deed

Residences in Jordan, Ayla’s included, are registered with the Department of Lands and Survey.

Real Estate Ownership Law No. 13 of 2019 places the real-estate register with that department and makes the title deed a document issued by the registration directorate. Once a residence is registered, the deed carries the details of the property and of the registered owner.

The sequence for a buyer runs in that order. Your agreement identifies your residence from the day you sign it. Final registration, and the title deed issued in your name, come at handover once the conditions in the agreement have been met. Between those two points the agreement is the document that records what you have bought, so keep your executed copy and the stamped unit plans together with your payment receipts.

The Permit That Comes Before Your Utilities

One approval stands between a finished building and a home you can live in.

Ayla sits inside the Aqaba Special Economic Zone, where Regulation No. 32 of 2004 on Zoning and Construction Licensing defines the occupancy permit as the written approval issued by the zone’s licensing body permitting a building to be used once it is built. The same regulation bars services being provided to a building or its occupants until that permit is issued.

Ask to see it at handover. It is the difference between keys and a home with power and water connected.

What Is Covered After You Move In

Ayla gives a one-year warranty from the date the residence is handed over to the new owner.

It covers everything in the apartment, with wear and tear and misuse excluded. Report defects in writing as you find them rather than saving them for a single list at the end of the year, and keep the correspondence, since the warranty runs from handover and not from the date you first notice a problem.

What To Collect At Handover

Handover is the point where several separate things become fixed at once, and it is easier to gather them on the day than to chase them afterwards.

Five documents are worth leaving with:

  • The occupancy permit for your building, issued by the zone’s licensing body
  • The final measured area of your residence, so the settlement against your agreement can be checked
  • Written confirmation of the handover date, since the warranty year runs from it
  • The service-charge schedule for the year ahead, itemised rather than given as a single figure
  • The snagging list you and Ayla agreed at inspection, signed by both sides

Keep these with your executed agreement and your payment receipts. The set of them is the record of what you bought, what you paid and when your cover started, and it is the first thing anyone will ask for if a question comes up later.

What Ayla Has Delivered Before

Past delivery is the part of a developer’s promise you can check yourself, and Ayla’s record in Aqaba is published.

On 1 September 2016 Ayla announced the handover of the first phase of Island Apartments, 150 units in fifteen buildings across two islands. On 23 December 2018 it announced Golf Residences delivered ahead of schedule. Azure Beach Apartments were delivered in May 2024. On 16 July 2026 Ayla announced the launch of phase two of Golf Residences alongside the completed handover of phase two of Island Apartments.

The wider portfolio runs to 256 Island Apartment units, 190 Azure Beach Apartments, 179 Golf Residences in phase one and 210 launched in phase two, beside a 231-berth marina. The Golf Residences have a guide of their own, where to buy a home on a golf course in Jordan, if that is the part of the portfolio you are weighing.

What You Own, And What You Pay For Each Year

Freehold ownership answers the first half of that. The recurring bill answers the second.

Ayla charges service charges. There is no separate sinking fund on top of them. Before you commit, ask for the service-charge schedule in writing and check what sits inside it: the maintenance of shared pools, landscaping, beach upkeep and the marina all land somewhere, and a resort community carries costs a city apartment does not.

You do not have to take that on trust. Ayla publishes audited service charge reports for the years already closed, running from 2023 to 2025. Read the one covering your estate before you ask what the year ahead will cost, because it shows what the money actually paid for.

Ask the same question about access. Get it clear in writing what you own against what you use under licence, covering the title area, balconies, parking, storage, common areas, club access, the management arrangement and the rental policy.

What Is Already Open Around The Home

Daily life runs on what is operating around you, not on the floor plan.

Ayla Golf Club is an 18-hole championship course designed by Greg Norman, with a nine-hole floodlit academy course alongside it. Hyatt Regency Aqaba Ayla, Cloud 7 Ayla Aqaba, Marina Village, La Plage Beach Club, Mama Gaia Beach Club and B12 Beach Club are presented by Ayla as part of the destination. Walk the community before you commit and separate what is open today from what is drawn.

Frequently Asked Questions

What Document Identifies The Residence You Are Buying At Ayla?

The Sale and Purchase Agreement, signed at purchase. Your unit is named in it individually, together with the plans it is measured against. The deed itself arrives later, at final registration.

Are Ayla Residences Freehold?

Yes, all of them. Freehold means the home is yours outright, with no term attached and no ground lease running underneath it.

How Are Payments Scheduled At Ayla?

The dates are agreed and confirmed before signing, then written into the agreement. For Golf Residences phase two, a buyer who decides not to proceed forfeits the down payment, and any remaining amounts paid are refunded in accordance with the agreement.

What Happens If The Finished Residence Is A Different Size?

The difference is settled in money. If the completed area is larger than the area stated in the agreement, the buyer pays for the extra. If it is smaller, Ayla refunds the difference. Request the measurement on paper at handover so the settlement can be checked against what you signed.

What Does The Ayla Warranty Cover?

Twelve months, starting the day the residence is handed over. Everything inside the apartment falls under it, apart from wear and tear and anything caused by misuse. Raise faults in writing as they appear, so each one carries a date.
